In 2018, Indiana passed new legislation to try and cut back on ESA fraud, something the state is taking very seriously. This means you will need to make sure you fully comply with the new regulations to keep your ESA rights.

The new law dictates that you need to have at least one therapy session before you get your ESA letter. To ensure that you comply with this, we’ve added one therapy session before your ESA consultation and two afterward the assessment process.

We advise great caution when shopping online with vendors who do no fully comply with Indiana’s new regulations.

The new laws introduced for emotional support animals state that anyone who misrepresents an animal as an ESA, or misrepresents their disability to obtain an ESA, is committing a Class A infraction

Imitating persons with disabilities, such as post-traumatic stress disorder/anxiety/depression/etc, to obtain an ESA is breaking the law. Putting a service dog or even emotional support dog vest on an ordinary pet who is not legally an ESA and pretending they are an ESA to avoid paying fees is also breaking the law.

The punishment for misrepresenting an assistance animal in Indiana is similarly severe. The punishment is up to a $10,000 fine and 100 hours of community service.
